Rezziva is committed to creating a safe, respectful, reliable, and professional transportation marketplace for Customers, passengers, drivers, and transportation providers.This Code of Conduct ("Code") applies to anyone who uses the Rezziva platform or participates in transportation arranged through Rezziva, including Customers, passengers, drivers, transportation companies, and other Operators.By using Rezziva or participating in a reservation arranged through Rezziva, you agree to follow this Code.1. Treat Everyone With RespectEveryone using Rezziva is expected to treat others professionally and respectfully.Harassment, intimidation, threats, discrimination, abusive behavior, unwanted sexual conduct, or violence will not be tolerated.This expectation applies to interactions:through the Rezziva platform;during booking;before pickup;during transportation;after transportation;and during communications between Customers, passengers, drivers, Operators, and Rezziva.2. Safety Comes FirstCustomers, passengers, drivers, and Operators must not intentionally engage in conduct that creates an unreasonable safety risk.Passengers must follow reasonable safety instructions provided by drivers.Drivers must operate vehicles safely and in accordance with applicable traffic and transportation laws.No person may intentionally interfere with a driver's ability to safely operate a vehicle.If a driver reasonably believes that continuing a trip would create an immediate safety risk, the driver may take reasonable steps to address the situation, including stopping transportation at a safe location where permitted by law.3. Driver and Operator ResponsibilitiesDrivers and transportation Operators using Rezziva are expected to provide professional and reliable transportation.Operators are responsible for ensuring that vehicles and drivers used to fulfill reservations comply with applicable legal and regulatory requirements.This may include maintaining:appropriate driver's licenses;commercial licenses where required;vehicle registrations;transportation permits or operating authority;legally required insurance;vehicle inspections;and other licenses or documentation required for the transportation being provided.Drivers must not operate a vehicle while impaired by alcohol, illegal drugs, medications that make driving unsafe, extreme fatigue, or another condition that prevents safe vehicle operation.4. Vehicle Safety and ConditionOperators are expected to provide vehicles that are reasonably clean, maintained, and suitable for the transportation service reserved.Vehicles must meet applicable safety and regulatory requirements.Known mechanical or safety issues that could make a vehicle unsafe should be addressed before transporting passengers.If a reserved vehicle becomes unavailable, the Operator should promptly communicate with Rezziva or the Customer and, when possible, provide an appropriate replacement.5. Customer and Passenger ResponsibilitiesCustomers are responsible for providing accurate reservation information.This includes accurate information regarding:pickup and destination locations;requested dates and times;passenger count;luggage or equipment requirements;requested stops;accessibility requirements communicated during booking;and other information reasonably necessary to provide transportation.Passengers are expected to respect the vehicle, driver, and other passengers.6. Passenger CapacityThe number of passengers may not exceed the lawful or authorized capacity of the vehicle.Every passenger must use available safety restraints when required by applicable law.Drivers and Operators may refuse to transport additional passengers when doing so would exceed the vehicle's permitted capacity or otherwise create a safety concern.7. Alcohol, Drugs, and ImpairmentIllegal drugs and unlawful controlled substances are prohibited in vehicles providing transportation through Rezziva.Passengers may not use, possess, or transport substances in violation of applicable law.Alcohol consumption may be prohibited or restricted depending on the vehicle, Operator, reservation, and applicable law.Drivers must never operate a vehicle while impaired.Severely intoxicated passengers who create a legitimate safety risk to themselves, the driver, or others may be refused transportation where permitted by law.8. Smoking and VapingSmoking or vaping inside a vehicle is prohibited unless the applicable Operator expressly permits it and doing so is lawful.Customers may be responsible for cleaning, deodorizing, or damage costs resulting from unauthorized smoking or vaping.9. Weapons and Dangerous ItemsPassengers may not bring unlawful weapons, explosives, hazardous materials, or other items that create an unreasonable safety risk into vehicles arranged through Rezziva.Lawfully possessed items remain subject to applicable law and reasonable safety restrictions established by the transportation provider.10. Harassment and DiscriminationRezziva does not tolerate unlawful discrimination or harassment.Customers, passengers, drivers, and Operators must not discriminate against or harass another person based on characteristics protected by applicable law.Sexual harassment, unwanted sexual advances, inappropriate touching, threats, stalking, intimidation, or other abusive conduct are prohibited.11. Respect the VehiclePassengers must treat vehicles with reasonable care.Passengers may be responsible for costs associated with damage or excessive cleaning caused by themselves or members of their party.Examples may include:intentional damage;broken equipment;excessive spills;bodily fluids;unauthorized smoking;excessive trash;or other conditions requiring cleaning or repair beyond ordinary use.Normal wear and tear is not considered passenger damage.12. Be Ready for PickupCustomers and passengers should be ready at the agreed pickup location at the scheduled time.Customers should provide accurate contact information so the driver or Operator can communicate regarding pickup when necessary.Drivers should make reasonable efforts to arrive at the designated location and communicate material delays when practical.Applicable waiting-time, late-arrival, and no-show policies may apply to individual reservations.13. Respect SchedulesCustomers and Operators should make reasonable efforts to honor confirmed reservation schedules.Customers should promptly communicate material changes to their transportation needs.Operators should promptly communicate significant delays, vehicle substitutions, cancellations, or other circumstances that may materially affect a reservation.14. No Fraud or MisrepresentationUsers may not intentionally provide false or misleading information to Rezziva, Customers, drivers, or Operators.Prohibited conduct includes:fraudulent reservations;fraudulent payment disputes;intentionally false complaints;falsified Operator documents;inaccurate vehicle representations;misrepresentation of licensing or insurance;impersonating another person or business;or manipulating the Rezziva platform for fraudulent purposes.15. Payments and FeesCustomers must pay legitimate charges associated with their reservations.Operators must comply with applicable Rezziva payment and payout requirements.Users may not improperly circumvent Rezziva's payment or booking systems for the purpose of avoiding fees owed under an applicable agreement with Rezziva.Fraudulent chargebacks, payment manipulation, or intentional avoidance of legitimate charges may result in suspension or termination from Rezziva.16. PrivacyCustomers, drivers, and Operators may receive personal information about one another when necessary to complete transportation.This information must be handled responsibly.Information obtained through Rezziva should not be used for unrelated purposes such as:unsolicited marketing;harassment;stalking;identity theft;selling personal information;or contacting someone for reasons unrelated to the reservation without an appropriate basis or consent.Personal information should only be retained for as long as reasonably necessary or legally required.17. Recording and PhotographyUsers should respect the privacy of others when taking photographs, video, or audio recordings.Drivers, Operators, and passengers are responsible for complying with applicable laws governing audio or video recording.Rezziva does not grant permission to record another person where consent is required by law.18. Service Animals and AccessibilityOperators and drivers must comply with applicable accessibility and nondiscrimination laws, including requirements relating to service animals and passengers with disabilities where applicable.Customers are encouraged to communicate accessibility requirements during the booking process when advance information would help arrange an appropriate vehicle or service.A passenger must not be unlawfully denied transportation because of a disability or lawful use of a service animal.19. Children and MinorsReservations involving minors must comply with applicable laws and the requirements of the transportation provider.The person making the reservation is responsible for communicating when transportation will involve minors where that information is reasonably necessary.Customers are responsible for providing legally required child safety seats or restraints unless the Operator has expressly agreed to provide them.20. Lost PropertyPassengers are responsible for their personal belongings.If property is left in a vehicle, Customers should contact Rezziva or the applicable Operator as soon as reasonably possible.Drivers and Operators should make reasonable efforts to report and return found property.Rezziva cannot guarantee that lost property will be located or returned.21. EmergenciesIf there is an immediate threat to someone's safety or a medical or other emergency, contact the appropriate emergency services.Rezziva's customer support services are not a substitute for emergency services.Safety-related incidents involving a Rezziva reservation should also be reported to Rezziva when appropriate so they can be reviewed.22. Reporting ViolationsCustomers, passengers, drivers, and Operators are encouraged to report serious violations of this Code to Rezziva.Reports should include as much relevant information as reasonably possible, such as:reservation information;date and time;description of the incident;individuals involved;and relevant supporting documentation.Reports may be submitted to: support@rezziva.com Rezziva may review reported incidents and request additional information from the individuals involved.23. EnforcementRezziva may take reasonable action when it determines that this Code, the Rezziva Terms of Use, an Operator agreement, or applicable law has been violated.Depending on the nature and severity of the conduct, actions may include:warnings;investigation;removal of content or listings;cancellation of reservations;temporary suspension;removal of an Operator or driver;termination of Platform access;withholding or adjusting amounts where authorized by an applicable agreement;or referral to appropriate authorities where necessary or legally required.Rezziva may take immediate action when reasonably necessary to address serious safety, fraud, or legal concerns.24. Cooperation With InvestigationsUsers are expected to reasonably cooperate with Rezziva when it investigates serious safety incidents, fraud, property damage, payment disputes, or violations of this Code.Rezziva may preserve or disclose relevant information when required by law or reasonably necessary to protect the rights and safety of Rezziva, Customers, passengers, Operators, drivers, or others.25. Relationship to Other Rezziva PoliciesThis Code should be read together with Rezziva's:Terms of Use;Privacy Policy;California Privacy Notice;applicable cancellation and refund policies;reservation-specific terms;and applicable Operator agreements.If there is a conflict between this Code and a specific written agreement between Rezziva and an Operator, the specific agreement will control with respect to that Operator to the extent of the conflict.26. Changes to This CodeRezziva may update this Code periodically to reflect changes to the Platform, transportation services, safety practices, or applicable requirements.The Effective Date above indicates when this Code was most recently updated.27.
